Terms of Service

Effective January 15, 2025

These Terms of Service (“Terms”) govern your use of unclassified.community and related services (the “Service”) provided by Unclassified (“Unclassified,” “we,” “us,” or “our”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Accounts

You may need an account to post listings, save searches, or use other features. You are responsible for the activity that occurs under your account and for keeping your credentials secure. Notify us immediately of any unauthorized use.

You agree to provide accurate information when registering and to keep that information current.

3. Listings and User Content

You are solely responsible for the listings and other content you submit (“User Content”). You represent that you own or have the rights to post your User Content, that it is accurate, and that it does not violate any law or third-party rights.

You grant Unclassified a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your User Content for the purpose of operating and promoting the Service.

We may review, edit, refuse, or remove any User Content at our discretion, including listings that are misleading, unlawful, or violate these Terms.

4. Prohibited Conduct

You agree not to:

• Post false, misleading, fraudulent, or illegal content;
• Post discriminatory content that violates fair housing or employment laws;
• Scrape, harvest, or copy content from the Service without permission;
• Use the Service to send spam, harass other users, or violate any law;
• Attempt to gain unauthorized access to the Service or interfere with its operation;
• Impersonate another person or misrepresent your affiliation with anyone;
• Use the Service in any way that infringes intellectual property rights.

5. Aggregated Content

Unclassified aggregates publicly available classifieds from community publications, websites, and groups. We make a good-faith effort to attribute sources and to keep listings accurate, but we do not guarantee the accuracy, completeness, or availability of any third-party listing. If you believe a listing should be removed, contact us.

6. SMS Messaging Terms

6.1 Consent. By providing your mobile phone number to Unclassified, you expressly consent to receive SMS text messages from us at the number provided, including messages sent using an automated system. Consent is not a condition of purchase or of using the Unclassified platform; you may use the platform without providing a phone number, though some features (such as account verification and listing inquiry notifications) require one.

6.2 Types of Messages. You may receive transactional and account-related SMS messages, including verification codes, inquiry notifications, listing status updates, and account alerts.

6.3 Message Frequency and Charges. Message frequency varies. Message and data rates may apply per your mobile carrier's plan. Unclassified is not responsible for any charges incurred from your wireless carrier.

6.4 Opt-Out. You may cancel SMS messages at any time by replying STOP to any message. After replying STOP, you will receive a confirmation that you have been unsubscribed. You will no longer receive SMS messages from us. To resubscribe, reply START.

6.5 Help. For assistance, reply HELP to any message or contact us at office@unclassified.community.

6.6 Carrier Disclaimer. Carriers (including but not limited to AT&T, Verizon, T-Mobile, and their affiliates) are not liable for delayed or undelivered messages. SMS service is provided on an as-available basis.

6.7 Eligibility. You must be the account holder or have authorization from the account holder of the mobile number you provide. By providing a mobile number, you represent that you are authorized to consent to receive SMS messages at that number.

6.8 Privacy. Your mobile phone number and SMS opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.

7. Intellectual Property

The Service, including its design, code, and original content, is owned by Unclassified and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our permission.

8. Third-Party Links

The Service may contain links to third-party sites or services. We do not control and are not responsible for the content, policies, or practices of any third-party site.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT LISTINGS WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UNCLASSIFIED WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold Unclassified and its affiliates harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service or request account deletion at any time.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in New York, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective” date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
